Notice of Privacy Practices

Important: This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Our Commitment to Your Privacy

North Carolina Personal Care Services is committed to protecting the privacy of your health information. We are required by law to maintain the privacy of your Protected Health Information (PHI), provide you with this Notice of our legal duties and privacy practices, and follow the terms of the Notice currently in effect. This Notice applies to all records of your care created or maintained by North Carolina Personal Care Services.

How We May Use and Disclose Your Health Information

We may use and disclose your PHI for the following purposes without your written authorization:

Treatment

We may use your PHI to provide, coordinate, or manage your care and related services. For example, we may share your care plan with other healthcare providers involved in your treatment.

Payment

We may use and disclose your PHI to obtain payment for services we provide. For example, we may share information with Medicaid, Medicare, your insurance company, or other payers to obtain reimbursement for your care.

Health Care Operations

We may use and disclose your PHI for our internal operations, including quality assessment, staff training, compliance reviews, and business management activities necessary to run our agency.

As Required by Law

We will disclose your PHI when required to do so by federal, state, or local law, including reporting requirements under North Carolina law.

Public Health Activities

We may disclose your PHI to public health authorities for activities such as preventing or controlling disease, injury, or disability, or reporting vital statistics as required by law.

Adult Protective Services

We may disclose your PHI to authorized government agencies if we believe you are a victim of abuse, neglect, or domestic violence, as permitted or required by law.

Health Oversight Activities

We may disclose your PHI to health oversight agencies for activities authorized by law, such as audits, investigations, and inspections by agencies that oversee the health care system.

Emergency Situations

We may use or disclose your PHI in an emergency treatment situation. If this happens, we will try to obtain your authorization as soon as reasonably practicable after the emergency.

Your Rights Regarding Your Health Information

You have the following rights regarding your PHI. To exercise any of these rights, please submit a written request to our Privacy Officer at the address listed below.

Right to Inspect and Copy

You have the right to inspect and obtain a copy of your PHI that we maintain in a designated record set, including your care records and billing records. We may charge a reasonable fee for copies.

Right to Amend

If you believe that PHI we have about you is incorrect or incomplete, you may request that we amend the information. We may deny your request under certain circumstances.

Right to an Accounting of Disclosures

You have the right to request a list of disclosures we have made of your PHI for purposes other than treatment, payment, health care operations, and certain other activities.

Right to Request Restrictions

You have the right to request restrictions on how we use or disclose your PHI for treatment, payment, or health care operations. We are not required to agree to your request except in limited circumstances required by law.

Right to Request Confidential Communications

You have the right to request that we communicate with you about your health matters in a certain way or at a certain location. For example, you may ask that we contact you only at a specific phone number or address.

Right to a Paper Copy of This Notice

You have the right to a paper copy of this Notice at any time, even if you have agreed to receive this Notice electronically. Contact our office to request a printed copy.

Right to Notification of a Breach

You have the right to be notified following a breach of your unsecured PHI as required by the HITECH Act and applicable federal and state law.

Our Duties

North Carolina Personal Care Services is required by law to maintain the privacy of your PHI and to provide you with this Notice of our legal duties and privacy practices. We are required to abide by the terms of this Notice as currently in effect. We reserve the right to change our privacy practices and the terms of this Notice at any time, provided such changes are permitted by applicable law. We reserve the right to make changes in our privacy practices and the new terms of our Notice effective for all PHI that we maintain, including PHI we created or received before we made the changes. Before we make a significant change in our privacy practices, we will change this Notice and make the new Notice available upon request.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with North Carolina Personal Care Services or with the Secretary of the U.S. Department of Health and Human Services. To file a complaint with us, contact our Privacy Officer in writing at the address below. We will not retaliate against you for filing a complaint. You may also submit a complaint directly to the U.S. Department of Health and Human Services at hhs.gov.
